Criminal Justice Act Information
Criminal Justice Act Panel Attorneys. Effective 1/1/2023, the CJA rate is $164.00 per hour for in-court and out-of-court work in all judicial districts for private "panel" attorneys accepting appointments under the Criminal Justice Act (CJA), 18 U.S.C. § 3006A.
The following are case maximums: $12,800.00 for felonies, $3,600.00 for misdemeanors, $2,700.00 for supervised release violations and witness representations.
For federal capital prosecutions and capital post-conviction proceedings, the hourly rate is $210.00.
Compensation maximums for expert service providers is $2,800.00; $900.00 or less without prior authorization. Court appointed counsel should file an ex parte motion and proposed order for expert services exceeding $900.00.
The current mileage rate is $0.655 per mile (effective 1/1/23).
Under the Court's CJA Plan, existing panel members are assigned to one of three groups. Pursuant to a staggered application process, existing panel members are required to reapply for membership every three years. Attorneys who are not currently members of the CJA panel may apply to become a panel member in any given year. In order to be considered for 2019 panel membership, non-panel members must submit a panel membership application to the Chair of the CJA Standing Committee on or before September 30, 2018. This requirement will renew from year to year, making the applicable deadline September 30th of the next calendar year for membership in the following year.
